Will You Pay Irish Tax if You Retire to Ireland?

Sharing is caring!

It depends on whether you become resident in Ireland for tax purposes, and Ireland’s Revenue service decides that by counting days. You are resident if you are present for 183 days or more in a tax year, or 280 days or more over two tax years taken together.

The day-count rules

Revenue sets out the test like this. You are resident for tax purposes if you are present in Ireland for:

  • 183 days or more in a tax year, or
  • 280 days or more in total, taking the current tax year plus the preceding tax year together.

You will not be resident in Ireland if you are there for 30 days or less in a tax year.

How the days are counted

  • Any part of a day counts as a day.
  • The tax year is the calendar year.

So a day you land late in the evening counts, and the count starts again each January.

What this means for a retiree on Stamp 0

Stamp 0 is the permission an American applies for to retire in Ireland when they have no Irish, European, or British passport. Two of its conditions matter here:

  • On the renewal form, you agree to reside in Ireland continuously.
  • For all permit holders, the guidance is that time out of the country should not exceed 90 days in a rolling year.

Will the same income be taxed twice?

Ireland has tax treaties with more than 70 countries, so that income taxed in one country is not taxed again in another.

How that works for your pension and your Social Security is personal. It depends on your own income and circumstances, and we cannot tell you what you will owe.

Get tax advice in both countries before you move.

A related point about your income

Tax is separate from the immigration income rule, but the two meet in your paperwork. For Stamp 0, the immigration service says you should have an individual income of €50,000 per year.

Your financial documents go into a spreadsheet, converted into euros, showing all income and spending each month. That spreadsheet must be certified by an Irish accountancy firm, not your accountant at home.

Since an Irish accountancy firm is already part of the application, that is a natural moment to ask about tax too.

In short

  • 183 days or more in a tax year: resident for tax purposes.
  • 280 days or more over the current and preceding tax years together: resident for tax purposes.
  • 30 days or less in a tax year: not resident.
  • Ireland has tax treaties with more than 70 countries.
  • Get tax advice in both countries before you move.
